Abstract
This paper provides a phenomenological legal analysis of the position of women within the political system of the Islamic Republic of Iran. It explores the challenges and contradictions in the policies concerning women's rights within the social and political transformations following the Islamic Revolution of 1979. The main research question is: How do the contradictions in the legal and social policies of the Islamic Republic of Iran concerning women’s rights lead to deconstruction within the political system? The hypothesis of this study suggests that the incoherence of the Iranian political system in responding to women's expectations and in establishing a clear and consistent stance on women's rights has resulted in structural contradictions and a crisis in the political system. Following the victory of the 1979 Islamic Revolution, Iranian women gained more opportunities for participation in social and political arenas; however, this transformation also brought new expectations that the system was unable to address coherently. This paper particularly emphasizes the contradictions in legal and social policies regarding women, including both limitations and opportunities. On the one hand, the Islamic Republic emphasizes the preservation of traditional Islamic values, while on the other hand, it reacts with contradictory and unstable responses to the increasing social demands of women for equal rights and greater freedoms. This situation represents deconstruction within the political system, which simultaneously attempts to preserve two conflicting discourses: advocating for women's participation in social spheres, while trying to restrict them within an ideological framework. Through the lens of postmodern concepts, this paper shows that the Iranian political system, in its efforts to maintain traditional and ideological structures, faces structural contradictions in the face of modernity and postmodern social transformations.
